ADR includes mediation, arbitration, and negotiation - and it's a necessary step before court. While you're not obliged to accept a settlement below what you feel is fair, courts will look dimly on disputants who haven't proactively tried to settle outside of court. Even if you win at trial, refusing reasonable ADR without good cause can result in cost penalties against you. Always document your settlement attempts.
